Terms and Conditions
Initial Term or Contract
The initial term of the server is decided upon when ordering. The agreement will be automatically renewed on the “renewal date” unless we are notified before hand. (Section 1.2 Termination)
Termination Policy
To terminate or cancel your account you must provide RockMyWeb, DBA (party A) with 7 days written notice before your (party B) “renewal date”. If you are canceling your service before the contract or term is up, without a refund request from RockMyWeb's customer service department, then you will still be responsible for 100% of the contracted price.
Payment Requirements
Payment of the agreed service between RockMyWeb, DBA (A) and you (B) must be made prior to you receiving the service. All payments are currently rendered through PayPal, Inc. or Google, Inc. and any credit card or electronic check issues must be handled with them. Any issues about the amount of payment owed and other billing inquiries are handled by RockMyWeb. You agree that no matter what, RockMyWeb will receive the full amount of what was due. Any late payments are subject to our 10% late charge and the service is subject to suspension. Failure to pay after 30 days will result in an additional 15% late charge and will be sent to a collections agency.
Chargebacks
You agree that you will pay in full of what you owe to RockMyWeb, DBA. If you feel like you have been charged incorrectly, please contact our billing department. Any credit card chargebacks will be subject to a $25.00 fee that will be sent to a collections agency if not received.
Extra Services
Any service ordered through our order form or negotiated with a sales agent of RockMyWeb, DBA must be paid for prior to receiving the extra service. You agree to pay for all charges attributable to your use of the Services at the then current RockMyWeb prices, which shall be exclusive of any applicable taxes. You are responsible for the payment of all federal, state, and local sales, use, value added, duty, excise and any other taxes assessed with respect to the services.
Refunds
Refunds are based on the current guarantees of Reseller3K, a subsidiary of RockMyWeb, DBA, or by negotiation with RockMyWeb's customer service department. The list of “Guarantees” are on the current web site of Reseller3K, a subsidiary of RockMyWeb, DBA, accessible at www.reseller3k.com. All refunds must be made through our customer service department.
Change in Terms
RockMyWeb, DBA (A) reserves the right to update any terms we feel necessary with one week notice to you (B). Any changes in terms will be set in place automatically for you (B) after a new “renewal date” or one week, whichever comes firsts.
Services
Acceptable Use Policy
Illegal Content – No content is allowed on any of our hosting that is illegal in the United States. Any unlawful content found will be removed and your account will be terminated.
Threats and Harassment – No content uses in any way to threaten or harass another person and or place of business will be allowed on our network. Any content found will result in termination of your account.
Fraudulence & Misuse – Use of RockMyWeb, DBA's service to participate in any activity knowingly deceiving the public, causing harm to computers, scams or pyramid schemes, or unsolicited emails (SPAM) will result in termination.
Unauthorized Access – Use of RockMyWeb, DBA's service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of RockMyWeb or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending account is subject to immediate termination.
Network disruptions - Use of the RockMyWeb, DBA's service for any activity which affects the ability of other people or systems to use RockMyWeb, DBA's Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. RockMyWeb, DBA will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
IRC, Adult & Proxy Hosting – Proxy, Adult, and IRC hosting are currently not allowed on our reseller3k hosting services.
On our web hosting accounts, resources are shared, meaning we have to keep in mind our other customers. RockMyWeb, DBA (A) reserves the right to suspend any account using unreasonable amount of resources upon further investigation or force you (B) to upgrade to a more friendly package. We will not charge anything without the permission of the customer unless overages have occurred. You can expect .5% CPU per GB of Disk Storage on the initial plan. Any upgrades on disk do not automatically include more CPU power, you will have to contact our sales department to arrange further.
Uptime Guarantee Policy
Our uptime guarantee is related to the network and service you are using. Our definition of downtime are periods of service where more than half of the internet is unable to reach your site for longer than 1 minute due to an issue with our server, not your services inside of the server. Attacks on our network are not subject to the uptime guarantee as they are out of our control. We will do our best to prevent such things from happening at all costs.
Backup Space Policy
You agree to pay in advance for services rendered for storage of up to your limit. The limit may be adjusted at anytime throughout the month with our billing department. We will notify you of your usage when you go over the space you are allocated. If you are over your storage, you will be forced to upgrade to the next plan so the backup service will still be available to you.
Important Note: RockMyWeb, DBA wants you to be satisfied with our service. This terms are only to protect both parties. Please feel free to contact our customer service department to discuss any terms or if you feel like we have mislead you. We are only here to help.
